A MONTH IN THE LIFE OF A BOARD-CERTIFIED CRIMINAL TRIAL ATTORNEY….

In the span of 30 days, Board-Certified Criminal Trial Attorney Dan Geherin of the Geherin Law Group, (GLGMichigan) fought and won cases for clients all over Washtenaw County.
Here are 5 highlights from the month:
February 21 2019: DOMESTIC VIOLENCE TRIAL ANN ARBOR DISTRICT COURT
T.C. is a young woman who was accused of Domestic Violence for allegedly shoving and slapping her boyfriend during an argument. She hired Dan to defend her and clear her name. At trial, the police testified that T.C. admitted to pushing her boyfriend, but they conceded under cross-exam that they did not witness what led up to that response. Dan argued that the prosecutor could not prove an intent to harm her boyfriend, and the judge agreed. She was found not guilty, and all records related to her arrest and charge were destroyed.
February 28 2019: SEXUAL ASSAULT PRELIMINARY HEARING WASHTENAW COUNTY TRIAL COURT
Dan defended University of Michigan Honors Student J.D., who was wrongfully accused of a sexual assault of another college student nearly 18 months earlier. Dan and J.D. reject all plea offers, and the Preliminary Examination becomes the battlefield. Dan surgically cross-examined the prosecutor’s witnesses and played video evidence for the judge, both of which help exonerate J.D. Although the prosecutor need only prove slight evidence of the crime at that stage, Dan successfully argued that the prosecution didn’t meet its burden. The judge agreed, and dismissed all charges against J.D., who will not face the excruciating prospect of being sent to prison and put on a sex-offender registry for a crime he did not commit.
March 11 2019: LARCENY TRIAL ANN ARBOR DISTRICT COURT
Dan represented C.G., a young professional journalist who was charged with a crime he simply did not commit. Dan and C.G. conduct several prep meetings, working together as a team to come up with persuasive evidence to show he could not have committed the crime. They prepped character witnesses who would testify that C.G. is honest and law-abiding. Dan presented this information to the prosecutor, who finally realized that the charge cannot be proven. The case is dismissed by the prosecutor before the first witness is called.
March 14 2019: DOMESTIC VIOLENCE TRIAL CHELSEA DISTRICT COURT
Professional Engineer R.M. spent three days in jail waiting to be Arraigned on a Domestic Violence charge stemming from an argument with her ex-husband four months earlier. She hired Dan. She and Dan worked hand-in-hand for months to present evidence about her ex-husband to show the court that he cannot be trusted. Despite R.M.’s clean record and lifetime of achievements, the prosecutor aggressively fought to convict her. R.M. held up perfectly to cross-examination, presented vidence to show her ex is a liar, and Dan argued that she is 100% innocent. She was found not guilty, and could get on with her life—without her ex in it.
March 18 2019: MDOP/ASSAULT TRIAL YPSILANTI TOWNSHIP DISTRICT COURT
L.N. is a young man who works as an auto repair specialist. After breaking up with his longtime girlfriend, she falsely accused him of intentionally smashing into her car and causing her injury. She reported the allegation to police and CPS, and tried to gain advantage in the custody battle over their son. For months, he was ordered to stay away from her and his son while the case slowly grinded through the system. He hired Dan to help him defeat these untrue charges. Dan aggressively cross-examined the ex-girlfriend, prepared him for testimony, and presented evidence of his innocence to the judge. The prosecutor threatened, then added, additional charges during trial. The judge saw through the claim, and found L.N. not guilty of all charges. L.N. could turn his attention to the custody battle, using evidence he and Dan found/used during the criminal process to help get back his son.
